AGREEMENT TO TERMS
Welcome to myScanBandz! By purchasing, registering, or using our products, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between the you and myScanBandz, LLC ("we," "us," or "our"), a Colorado limited liability company.

DESCRIPTION OF SERVICE
myScanBandz provides QR code-enabled safety products, including wristbands, stickers, temporary tattoos, and other formats, designed to help reunite lost children with their parents or guardians at events, crowded venues, and public spaces. When a child becomes lost, a third party may scan the QR code contained on the product, which will provide the third party with the child’s first name, the name of the child’s parent/guardian, and the parent/guardian’s contact information. Parents/guardians may include additional health information about their child, such as a child’s allergies and medical conditions, in the event a medical emergency arises when the child’s parent/guardian has not been reunited with their child. myScanBandz also provides bulk orders of products for groups of children, such as during school field trips or other events involving a large group of children.
Our products are reunion tools and not prevention devices. They help someone who finds a lost child contact the child’s parent or guardian, but they do not prevent a child from becoming lost, track a child's location, or guarantee safety.

ELIGIBILITY AND ACCOUNT REGISTRATION
Age Requirement
You must be at least 18 years old to purchase and register myScanBandz products. By using our products, you represent that you are at least 18 years of age.
Parental Authority
By registering a product for a child, you represent and warrant that you are the parent or legal guardian of that child and have the authority to provide consent for the collection and use of the child's information as described in our Privacy Policy.
Children's Information: Compliance With COPPA and Colorado’s Privacy Act
We comply with the Children's Online Privacy Protection Act, 16 CFR Part 312 (“COPPA”) and Colorado’s Privacy Act (C.R.S. § 6-1-1301, et seq.). By registering a product for a child under 13, you:
- Provide verifiable parental consent for us to collect the child's first name or additional, optional information you provide (i.e. medical conditions);
- Acknowledge that this information will be publicly displayed when the QR code is scanned, and;
- Understand you may request deletion of this information at any time by contacting us at support@myscanbandz.com.
We collect only the minimum information necessary for emergency reunification purposes. We do not collect information directly from children, and we do not share or sell children's information with third parties for marketing or other purposes. Consult our Privacy Policy and Information Practices for more information.
Account Information
When registering a product, you agree to:
- Provide accurate, current, and complete information;
- Maintain and promptly update your contact information;
- Keep your product code confidential and secure, and;
- Notify us immediately of any unauthorized use.
You are responsible for ensuring your contact information remains current and accurate. Outdated information may delay or prevent reunion if your child becomes lost.

PRODUCT USE AND LIMITATIONS
Intended Use
myScanBandz products are intended to:
- Display parent/guardian contact information when scanned;
- Facilitate communication between a finder and a parent/guardian, and;
- Assist in reuniting lost children with their families.
Our products are NOT:
- GPS tracking devices or location monitors;
- Prevention tools that stop children from becoming lost;
- Substitutes for parental supervision;
- Guarantees of safety or reunion;
- Medical alert devices or HIPAA-compliant systems;
- Government-issued identification, or;
- Security systems or protective devices.
Limitations
We cannot and do not guarantee that:
- A lost child will be found;
- Someone will scan the QR code;
- The person scanning the QR code has good intentions or will provide assistance;
- The QR code will scan in all conditions (damage, dirt, water, low light, etc.);
- Wireless connectivity will be available when needed;
- The product will remain attached, visible, or intact, or;
- Emergency services will be contacted or will respond.
Medical Information Disclaimer
Our products are NOT medical alert devices and we do not represent compliance with any laws, rules, or regulations governing medical devices. Any medical or health information you choose to provide is completely optional. Any medical or health information you provide will be displayed publicly to anyone who scans the QR code. Only include medical information you are comfortable sharing with any member of the public who might find your child. It is your responsibility to ensure any medical or health information you provide is current and accurate.
User Responsibilities
You are responsible for:
- Supervising your children at all times;
- Teaching your child how to seek help when lost;
- Properly applying and securing the product;
- Replacing products that are damaged or worn;
- Following venue- or location-specific safety rules and protocols;
- Understanding that our products do not replace responsible supervision, and;
- Ensuring the information you provide is accurate and current.
myScanBandz products are tools to assist reunion efforts. They do not replace responsible parental supervision nor guarantee any outcome.

PRODUCT REGISTRATION
Registration Process
To activate your myScanBandz product:
1. Scan the QR code or visit myscanbandz.com/pages/band-lookup.
2. Enter the unique product code.
3. Provide required contact information.
4. Review the information carefully.
5. Check all the consent boxes.
6. Submit the registration form.
Registration is required for the product to function. Unregistered products will prompt registration when scanned.
After registration, you can make later updates and revisions to your information as needed. If you use the original phone that was used to initially register the product along with the phone number that was used to register the product, changes to your information can be made on the registration page. If you have any issues with changing or updating your information, contact us at support@myscanbandz.com.
Public Display of Information
CRITICAL NOTICE: When you register a myScanBandz product, the contact information you provide becomes PUBLICLY ACCESSIBLE to anyone who scans the QR code. This includes:
- Child, group, or individual name;
- Contact person name and phone number;
- Email address (if provided), and;
- Medical or safety information (if provided).
This information is NOT password-protected, restricted, or monitored. Anyone with physical access to the product can view this information by scanning the QR code with any smartphone.
By registering a product, you explicitly consent to this public display of information for emergency reunification purposes. You acknowledge that:
- We cannot control who scans the QR code;
- We cannot verify the intentions of people who scan the code;
- We are not responsible for how others use the displayed information, and;
- The information remains publicly accessible so long as the product is registered.
If you are not comfortable with this public display of information, do not register the product.
Registration Accuracy
You must provide accurate contact information during registration. Incorrect information may prevent successful reunion. We are not responsible for failed contact attempts due to inaccurate, outdated, or incomplete information. It is your responsibility to keep your contact information current. You may update your information at any time by contacting support@myscanbandz.com.
Multiple Products
You may register multiple products under the same contact information. You may also register different products with different contact information if needed (e.g., one parent versus another or different children with different emergency contacts).
Group Registrations
For bulk/group orders (schools, camps, teams), which consist of an order of 25 or more products, one adult may register a group code that applies to multiple products. The registering adult represents that they have authority to provide contact information on behalf of the group and have obtained necessary consents from parents or guardians.

PURCHASES AND PAYMENT
Pricing
All prices are in U.S. dollars and are subject to change without notice. The price you pay is the price displayed at the time of purchase.
Payment
Payments are processed securely through Shopify's payment platform. We do not store your payment information. By making a purchase, you agree to Shopify's terms of service and privacy policy.
Order Acceptance
We reserve the right to refuse or cancel any order for any reason, including:
- Product unavailability
- Errors in pricing or product information
- Suspected fraudulent transactions
- Violations of these Terms
- Limitation on quantities available for purchase
If we cancel an order, we will refund any payment received. See our Refund and Return Policy for more information.

REFUNDS AND RETURNS

Unused and Unregistered Products
Unused and unregistered products may be returned within 30 days of delivery for a full refund, minus shipping costs. Products must be in original condition to qualify for a refund.
Registered Products
Once a product is registered with your contact information, it cannot be returned or refunded. Registration activates the product and associates it with your personal information, making it non-returnable for privacy and hygiene reasons.
Defective Products
Products that arrive defective may be returned within 30 days of discovering the defect. You may receive either a replacement product or refund for a defective product, regardless of whether the product has been registered or not. See the section below on “Reporting Defects” for more information.
Bulk Orders
For bulk orders (25+ units), contact us at support@myscanbandz.com before purchase to discuss the terms of the order. Bulk orders may have different return policies. To initiate a return or report a defect, email support@myscanbandz.com with your order number and description of the issue.

PRODUCT QUALITY AND DEFECTS
Our Commitment
We strive to provide quality products that function as described. If your product is defective, we will replace it or provide a refund.
Reporting Defects
To report a defective product:
- Email support@myscanbandz.com within 30 days of discovering the defect.
- Include your order number and a description of the defect.
- Provide a photo of the defect, if possible.
We will respond to your email with instructions for returning and replacing the product.
Normal Wear and Tear
Our products are subject to normal wear and tear. We are not responsible for products that (including but not limited to):
- Become damaged through normal use or environmental exposure;
- Are exposed to extreme conditions (excessive water, heat, chemicals, rough surfaces, etc.);
- Are deliberately damaged, misused, or modified;
- Lose adhesion over time (e.g., stickers, temporary tattoos, etc.);
- Fade, tear, or deteriorate with extended use, or;
- Are damaged by the user or third parties.

INTELLECTUAL PROPERTY
Our Property
All content on the myScanBandz website and products are the intellectual property of myScanBandz, including but not limited to:
- The myScanBandz name, logo, and trademarks;
- Website design, layout, and user interface;
- Product designs and packaging;
- Text, graphics, images, and photographs;
- Software, code, and technical processes, and;
- QR code generation and lookup system.
The above intellectual property is owned by myScanBandz, LLC and protected by copyright, trademark, and other intellectual property laws.
Your License
We grant you a limited, non-exclusive, non-transferable license to use our website for personal, non-commercial purposes and use our products as intended for personal or family use.
You may NOT:
- Copy, modify, reproduce, or create derivative works of our content;
- Use our trademarks, logos, or branding without written permission;
- Reverse engineer or attempt to extract source code from our systems;
- Resell products in bulk without an authorized reseller agreement;
- Use our products or services for commercial purposes without authorization, or;
- Interfere with or disrupt our services or systems.

LIMITATIONS OF LIABILITY

No Guarantees
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSCANBANDZS PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSCANBANDZS, LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES;
- PERSONAL INJURY, EMOTIONAL DISTRESS, PAIN AND SUFFERING, OR WRONGFUL DEATH;
- FAILURE TO REUNITE A LOST CHILD WITH PARENTS OR GUARDIANS;
- HARM, INJURY, OR DAMAGES CAUSED BY THIRD PARTIES WHO SCAN THE QR CODE OR ACCESS YOUR INFORMATION;
- PRODUCT FAILURE DUE TO DAMAGE, ENVIRONMENTAL CONDITIONS, USER ERROR, OR CIRCUMSTANCES BEYOND OUR CONTROL;
- DAMAGES RESULTING FROM LOST, STOLEN, OR DAMAGED PRODUCTS;
- DAMAGES RESULTING FROM INACCURATE, OUTDATED, OR INCOMPLETE REGISTRATION INFORMATION;
- DAMAGES RESULTING FROM QR CODES THAT FAIL TO SCAN DUE TO LIGHTING, DEVICE ISSUES, OR OTHER TECHNICAL PROBLEMS, OR;
- ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE OUR PRODUCTS OR SERVICES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.
Assumption of Risk
You acknowledge and agree that:
- Use of our products involves inherent risks;
- No product can guarantee a child's safety, prevent loss, or ensure reunion;
- You assume all risks associated with using our products;
- We are not responsible for outcomes related to lost children or emergency situations;
- Our products are tools only and do not replace supervision, judgment, or emergency services, and;
- You are solely responsible for the safety and supervision of your children.
Indemnification
You agree to indemnify, defend, and hold harmless myScanBandz, LLC, its owners, officers, employees, agents, and affiliates from any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to:
- Your use or misuse of our products or services;
- Your violation of these Terms or any applicable law;
- Your violation of any third-party rights, including privacy rights;
- Inaccurate, false, or misleading information you provide during registration;
- Your failure to supervise your children or maintain accurate contact information, and;
- Any content you submit or transmit through our services.

Your use of our products and services is also governed by our Privacy Policy and Information Practices, which is incorporated into these Terms by reference. Please review our Privacy Policy and Information Practices carefully to understand how we collect, use, and protect your information.

THIRD-PARTY SERVICES
Our website and services integrate with third-party services including but not limited to:
- Shopify (e-commerce platform and payment processing);
- Airtable (database and product registration system);
- Analytics and advertising services, and;
- Social media platforms.
We are not responsible for:
- The availability, functionality, or security of third-party services;
- The privacy practices or terms of third-party services;
- Any damages or losses resulting from your use of third-party services, and;
- Actions or omissions of third-party service providers.
Your use of third-party services is subject to their own terms and privacy policies.
Modifications to Service
We reserve the right to:
- Modify, suspend, or discontinue any aspect of our products or services at any time, with or without notice;
- Change pricing, features, or product specifications, and;
- Update these Terms as needed.
We will provide reasonable notice of material changes when possible. Continued use of our products after changes indicates your acceptance of the modified Terms. Products you have already purchased and registered will continue to function according to their original specifications, but we do not guarantee indefinite support for discontinued products.

TERMINATION
Your Rights
You may stop using our products and services at any time. You may request deletion of your product registration and associated information as described in our Privacy Policy and Information Practices. Note that deleting your registration will cause the QR code to stop displaying your contact information.
Our Rights
We may suspend or terminate your access to our services or delete your product registration if you, including but not limited to:
- Violate these Terms or our Privacy Policy and Information Practices;
- Provide false, misleading, or fraudulent information;
- Engage in fraudulent, illegal, or abusive activity;
- Use products in a way that harms others, our business, or our reputation;
- Fail to pay for products or services, or;
- Request a chargeback or payment dispute without first contacting us.
Effect of Termination
Upon termination:
- Your right to use our services immediately ceases;
- We may delete your account and registration information;
- QR codes will no longer display your contact information;
- You remain liable for any outstanding obligations, and;
- Sections of these Terms that by their nature should survive termination will survive.

DISPUTE RESOLUTION
Governing Law
These Terms and any disputes arising from or related to them shall be governed by and construed in accordance with the laws of the State of Colorado.
Informal Resolution
If you have a dispute with us, please contact us first at support@myscanbandz.com. We will work in good faith to resolve the issue informally within 30 days.
You agree to provide a written description of your dispute, including:
- Your contact information;
- Product code or order number;
- Description of the dispute, and;
- Desired resolution.
We will respond with our proposed resolution. If the dispute cannot be resolved informally, the parties shall proceed with mediation and, if the dispute is not resolved during mediation, the dispute shall be settled in binding arbitration.
Mediation
All claims, disputes and other matters in controversy between the you and myScanBandz, LLC, our agents, employees, officers, directors, principals, successors, assigns, subsidiaries or affiliates arising from or relating to these Terms and their interpretation, or through your use of our products and/or services shall be submitted for resolution by non-binding mediation conducted under the auspices of the Judicial Arbitration and Mediation Services (“JAMS”) The commencement and completion of mediation proceedings pursuant to the foregoing is a condition precedent to commencing arbitration proceedings pursuant to the paragraph below.
Arbitration
All claims, disputes and other matters in controversy that cannot be resolved informally or through mediation shall be resolved on an individual basis only through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Eagle County, Colorado, or by telephone/video conference if mutually agreed. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
By using our products and services and agreeing to the Terms, you agree to waive any and all rights to a trial by jury, to the litigation of disputes in state or federal courts of general jurisdiction, and to participate in any way in a class action/class arbitration, private attorney general action, or otherwise make or proceed with any claim on a collective or consolidated basis.
Costs of Dispute Resolution
The parties agree that the prevailing party in any mediation or arbitration action relating to or arising out of the Terms or through your use of our products and/or services will be awarded its reasonable attorneys’ fees and costs incurred as a result of such a proceeding.
Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES WITH US ONLY ON AN INDIVIDUAL BASIS AND WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE PROCEEDINGS.
You may only resolve disputes with us in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Limitation on Time to File Claims
You agree that any claim or cause of action arising out of or related to these Terms or our products or services must be filed within one (1) year after the claim or cause of action arose, or it will be permanently barred.

GENERAL TERMS
Entire Agreement
These Terms, together with our Privacy Policy and Information Practices, our Refund and Return Policy, and any other policies referenced herein, constitute the entire agreement between you and myScanBandz, LLC regarding use of our products and services, and supersede any prior agreements or understandings.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
No Waiver
Our failure to enforce any provision of these Terms, or to exercise any right or remedy, does not constitute a waiver of that provision, right, or remedy. No waiver shall be effective unless in writing and signed by an authorized representative of myScanBandz, LLC.
Assignment
You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms to any successor, affiliate, or third party without your consent, including in connection with a merger, acquisition, reorganization, or sale of assets.
Force Majeure
We are not liable for any failure or delay in performance of our obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, fires, etc.)
- Pandemics, epidemics, or public health emergencies
- War, terrorism, or civil unrest
- Government actions, laws, or regulations
- Internet outages or failures of telecommunications
- Failures of third-party service providers (Shopify, Airtable, etc.)
- Labor disputes or strikes
